PUBLIC NOTICE OF APPLICATION FOR RECLAMATION LIABILITY FOR SURFACE COAL MINING AND RECLAMATION PERMIT PERMIT NO. 34E, LUMINANT MINING COMPANY LLC, MONTICELLO-WINFIELD MINE DOCKET NO. C10-0014-SC-34-F, 418.0 ACRES, PHASE I
Pursuant to Section 134.128 - .134 of the Texas Surface Coal Mining and Reclamation Act, TEX. NAT. RES. CODE ANN. (Vernon 2010) and Section 12.312 - .313 of the Coal Mining Regulations, Tex. R.R. Comm’n, 16 TEX. ADMIN. CODE Ch. 12 (West 2010), Luminant Mining Company LLC, 500 N. Akard Street, Dallas, Texas 75201, has submitted its application to the Railroad Commission of Texas for Phase I release of reclamation obligations for 418.0 acres of its Monticello-Winfield Mine Permit No. 34E in Titus and Franklin Counties, Texas. The Monticello-Winfield Mine permit area is located in Titus and Franklin Counties, Texas, approximately two miles north and west of Mount Pleasant, Texas. Permit No. 34E was approved on October 23, 2007.
The applicant requests a release of Phase I, (60%) reclamation obligations on 418.0 acres. The areas proposed for release are located northwest of the intersection of Lake Monticello and FM 127 and shown on the map printed with this public notice. Mining operations were conducted on the 418.0 acres in 2000–2003. Final grading was accomplished on this area in 2001–2004, and in 2002–2007 vegetation was planted. This area was accepted into the five year extended responsibility period on August 24, 2009 by the Railroad Commission of Texas. The approved postmine land use for this acreage is pastureland (92.2 acres), fish and wildlife habitat (86.3 acres), developed water resources (82.6 acres), and forestry (156.9 acres). The acreage requested for release contains 1 permanent diversion, 3 permanent impoundments, 5 permanent drop structures, and 5 permanent roads.
The accepted bond for Permit No. 34E is $87,000,000. The applicant does not seek adjustment to the approved bond as a result of this application; however, an eligible bond reduction amount may be determined.
