This Notice shall satisfy the above-cited two separate but related procedural notification requirements.
REQUEST FOR RELEASE OF FUNDS
On or about March 26, 2012, Franklin County will submit a request to the Office of Rural Affairs within the Texas Department of Agriculture for the release of Texas Community Development Block Grant (TxCDBG) funds under the Section 104(f) of Title I of the Housing and Community Development Act of 1974 as amended, to undertake a project known as TxCDBG Contract #711200 on behalf of Cypress Springs SUD, for the purpose of improving water system storage and capacity to bring water treatment plant #1 into TCEQ compliance. Construction shall include the installation of a two hundred thousand gallon (200,000 gal.) elevated storage tank, yard piping, site work, foundation and all associated appurtenances. Construction shall take place at water treatment plant #1 located on County Road 900. These activities shall benefit one thousand twenty-six (1,026) persons, of which five hundred forty-six (546) or fifty-three percent (53%) are of low to moderate income.
FINDING OF NO SIGINIFICANT IMPACT
The County has determined that the project will have no significant impact on human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Franklin County Annex East located at 502 E. Main St., Mt. Vernon, TX and may be examined or copied weekdays 9 A.M. to 4 P.M.
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the County. The comment period begins March 9, 2012 and ends March 23, 2012. All comments received by March 23, 2012 will be considered by the County prior to authorizing submission of a request for release of funds. Commentors should specify which part of the Notice they are addressing.
RELEASE OF FUNDS
The County certifies to the Office of Rural Affairs within the Texas Department of Agriculture that Paul Lovier in his capacity as County Judge consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Office’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the County to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
The Office of Rural Affairs within the Texas Department of Agriculture will consider objections to its release of funds and the County’s certification received by April 11, 2012, or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer or other officer of the County approved by the Office; (b) the County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the Office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the Office of Rural Affairs at Texas Department of Agriculture, P.O. Box 12847, Austin, Texas 78711. Potential objectors should contact the Office to verify the actual last day of objection period.
