NOTICE TO DEFENDANT: “You have been sued. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty-two (42) days after the date of issuance of this citation and petition, a default judgment may be taken against you.”
You are hereby commanded to appear by filing a written answer to the Plaintiff’s Original Petition at or before 10:00 o’clock A.M. on the Monday next after the expiration of 42 days after the date of issuance of this citation the same being Monday, October 29, 2012 before the Honorable Scott McDowell, 62nd District Court of Franklin County, at the Courthouse Annex, 208 TX HWY 37S, in said County in Mount Vernon, Texas. Said Plaintiff’s Original Petition was filed in said court on the 22nd day of July 2012 in the above entitled cause.
A brief statement of the nature of this suit is as follows, to-wit:
ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND BEING A PART OF THE S. KEITH SURVEY, A-268 LOCATED IN THE EASTERN SECTION OF THE CITY OF MOUNT VERNON, FRANKLIN COUNTY, TEXAS BEING A PART OF A TRACT OF LAND DESCRIBED IN A DEED FROM N.E. DUPREE TO O.T. TRAMALLS DATED SEPTEMBER 22, 1945 RECORDED IN VOL. 63 PAGE 162 OF THE DEED RECORDS OF FRANKLIN COUNTY, TEXAS BEING A PART OF A 4 ACRE TRACT OF LAND DESCRIBED IN A DEED FROM LELA TRAMALLS TO OBIE HARGRAVES ET UX JESSIE MAE HARGRAVES DATED AUGUST 9, 1968 RECORD IN VOL. 93, PAGE 33 OF THE DEED RECORDS OF FRANKLIN COUNTY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT 3/8 INCH SPIKE NAIL SET IN THE CENTER OF A PUBLIC ROAD FOR THE NORTHEAST CORNER BEING THE NORTHEAST CORNER OF SAID 4 ACRE TRACT SAID POINT BEING N 1 DEG 17 MINS 19 SECS W.A. DISTANCE OF 646 FEET FROM THE CENTERLINE OF GRADY STREET;
THENCE S 1 DEGREES 17 MINUTES 19 SECONDS E ALONG THE CENTERLINE OF A PUBLIC ROAD A DISTANCE OF 530.58 FEET TO A 3/8 INCH SPIKE NAIL FOR THE SOUTHEAST CORNER;
THENCE S 88 DEGREES 44 MINUTES 43 SECONDS W A DISTANCE OF 109.33 FEET TO A 3/8 INCH SPIKE NAIL SET AT THE BASE OF A CORNER FENCE POST;
THENCE N 1 DEGREES 42 MINUTES 27 SECONDS W ALONG A FENCE A DISTANCE OF 158.74 FEET TO A 3/8 INCH SPIKE NAIL SET IN THE WBL OF SAID 4 ACRE TRACT FOR THE SOUTHWEST CORNER;
THENCE N 1 DEGREE 32 MINUTES 26 SECONDS W ALONG A FENCE LINE A DISTANCE OF 506.51 FEET TO A 3/8 INCH SPIKE NAIL SET IN THE CENTER OF A PUBLIC ROAD THE NORTHWEST CORNER BEING THE NORTHWEST CORNER OF SAID 4 ACRE TRACT;
THENCE N 88 DEGREES 44 MINUTES 54 SECONDS 3 ALONG THE CENTER OF A PUBLIC ROAD A DISTANCE OF 270.28 FEET TO A 3/8 INCH SPIKE NAIL SET FOR THE NORTHEAST CORNER BEING THE POINT OF BEGINNING AND CONTAINING 3.20 ACRES OF LAND MORE OR LESS OF WHICH .20 ACRE LIES IN THE BOUNDS OF A PUBLIC ROAD LEAVING A NET ACREAGE OF 3 ACRES OF LAND MORE OR LESS.
