TO: The Heirs of Joe Elder, Deceased; Jewel Elder, Deceased, Grady Elder, Deceased; and Their Unknown Heirs Defendant - Greeting
Notice to Defendant: “You have been sued. You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10 a.m. on the Monday next following the expiration of 42 days after the date this citation was issued, a default judgment may be taken against you.”
You are hereby commanded to appear by filing a written answer to the Plaintiff’s Petition at or before 10:00 o’clock a.m. on the first Monday next after the expiration of 42 days from the date of the issuance of this citation, the same being Monday, December 17, 2018, before the Honorable 62nd Judicial District Court of Franklin County at the Court House in Mount Vernon, Texas, Said Plaintiff’s Petition was filed in said court on the 2nd day of November, 2018 in the above entitled cause.
A brief statement of the nature of the suit is as follows: to wit:
The suit is a trespass to try title auction to settle title to a tract of 10-2/3rds acres of land in the Charles Sims Survey, A-417, Franklin County, Texas as more fully shown by Plaintiff’s Petition on file in the suit.
Issued and given under my hand and seal of said Court, at office in Mount Vernon, Texas on this the 5th day of November, 2018.
