Public Notice -NOTICE OF ADOPTION OF CHANGES TO RULES AND REGULATIONS OF FRANKLIN COUNTY WATER DISTRICT - 01-21-2021

Pursuant to Section 51.129 of the Texas Water Code, notice is hereby given that on the 17th day of November 2020,

the Board of Directors of Franklin County Water District (the “District”) adopted amendments to the Rules and Regulations of Franklin County Water District (“Rules”), which contain provisions relating to the use of Lake Cypress Springs (the “Lake”), including: (a) addition providing for approved mooring buoys; (b) prohibiting of hunting on property owned by the District; (c) requiring watercraft to operate at idling speed in restricted zones; (d) prohibiting commercial businesses that rent, utilize, or operates certain specialized recreational devices for use on the Lake; (e) requiring a permit for activities on or around the Lake that require heavy equipment; and (f) general modification of provisions inconsistent with the Texas Water Safety Act (the “Act”). In particular, the Rules also provide the following:

Article II is modified to state that the District shall designate restricted areas on the Lake with marker buoys; provides that no buoys shall be placed on the Lake without District approval; and adds provisions to allow mooring buoys with District approval and subject to District requirements.

Article IV is modified to prohibit hunting on property owned by the District and deleting the prohibition on commercial fishing.

Article V is modified to remove provisions limiting the size of watercraft on the Lake; modifying provisions requiring idling by watercraft to clarify that idling is required in designated restricted areas; clarifying that impoundment of watercraft will be done according to the Act; removing requirements for wearing safety flotation devices; and adding language to prohibit commercial businesses that rent, utilize, or operates certain specialized recreational devices for use on the Lake.

Article VI is modified to delete certain swimming prohibitions.

Article XV is modified to require a permit for any construction, dredging, or other activities on the Lake that require the use of heavy equipment on or around the Lake.

Pursuant to Texas Water Code § 51.128, the Rules shall be recognized by the courts as if they are penal ordinances of a city, and any breach of the Rules may subject the violator to a penalty, default of a District lease, or revocation of a District permit. Each violation of the Rules constitutes a Class C Misdemeanor.

This notice is a summary statement of the District’s Rules and does not contain all of the specific provisions and requirements established by the Rules. A copy of the Rules is on file in the office of the District, 112 N Houston Street, Mount Vernon, Texas 75457 where it may be read by any interested person.
